Washington, D.C. — A newly surfaced FBI document has triggered bipartisan alarm in Congress, revealing that the bureau conducted toll record analysis on nine sitting Republican senators as part of a sensitive election law investigation. The document, marked UNCLASSIFIED//FOUO (For Official Use Only), was issued by the FBI’s Washington Field Office on September 27, 2023, and references the “Arctic Frost” probe—an operation later linked to Special Counsel Jack Smith’s elector case against President Donald Trump.

The document confirms that preliminary toll analysis was conducted on communications associated with:

Political Fallout
Senator Chuck Grassley (R-IA) described the surveillance as “worse than Watergate,” stating:
“This document shows the Biden FBI spied on eight of my Republican Senate colleagues during its Arctic Frost investigation into ‘election conspiracy.’ The American people deserve answers.”
Senator Josh Hawley (R-MO), one of the named individuals, demanded a special prosecutor and congressional oversight hearings, writing:
“Biden’s FBI spied on my phone calls AND tracked my location. They also targeted parents, pro-lifers, and 92 conservative organizations. We need a thorough investigation—and prosecutions.”
Senate Minority Whip John Thune (R-SD) added:
“I have grave concerns about this report and fully support Senate committees getting to the bottom of this outrageous abuse of power and weaponization of the government.”
Legal and Constitutional Questions
Legal scholars warn that surveillance of sitting senators—especially without judicial oversight—may violate the Speech or Debate Clause of the U.S. Constitution, which protects legislative independence. The FBI has not publicly commented on the document, and Director Christopher Wray has yet to respond to calls for clarification.
